CONTEST RULES

Tickets for the Opportunity Drawing are offered for purchase and  sent to all STOP CANCER members and an extensive mailing list of non-members. Anyone who wishes to obtain Opportunity Drawing tickets ($200 per ticket and three tickets for $500)  may contact the STOP CANCER office at 310-841-2600. All Opportunity Drawing tickets must arrive at the STOP CANCER office by October 27, 2008 to be eligible to win. No purchase or donation is required to participate in the drawing. STOP CANCER will refund all payments for tickets received after the deadline. STOP CANCER is not responsible for any misdirected mail or delayed mail for any reason and in such cases the entry will be deemed invalid and a refund will be issued. In this regard, the decision by STOP CANCER will be final. Tickets may be personally delivered to the STOP CANCER office prior to the deadline.

The winner of the 2009 Lexus LS 460 Opportunity Drawing will be posted on the STOP CANCER website following the 2008 HalloWeekend Classic.. 

The winner will be chosen at a public drawing held on November 2, 2008.  Ticketholder need not be present to win. The odds of winning are directly related to the number sold. If one thousand tickets are sold, a person who has purchased a single ticket will have one chance in a thousand to win.

All participants must be at least 18 years of age at the time of the purchase, legally residing in the United States and the holder of a current driver’s license.

 It is the responsibility of the winner to pay appropriate taxes and licensing fees. Specifically, the winner shall be responsible for all taxes, license, title and registration fees and any other costs, including without limitation any travel or transportation costs, associated with winning the prize vehicle. STOP CANCER  shall be responsible for collection of income tax from the winner for IRS;

The winner may not be an employee of Toyota Motor Sales, U.S.A., Inc. (“TMS”), that entity’s advertising agencies, or any of the aforementioned entities’ affiliates or subsidiaries, nor an individual domiciled with any such employee;

The winner may not be an employee of STOP CANCER nor an individual domiciled with any such employee.;

Prizes are non-transferable, and no substitutions on any prizes (except that Charity and/or TMS reserves the right to substitute prizes of equal or greater value);

TMS shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with prizes provided pursuant to the Contest; provided, however, that TMS shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner’s Guide for the Donated Vehicle;

The depiction of the prize vehicle in any advertising or promotional materials does not necessarily reflect the actual vehicle delivered to the winner.

The STOP CANCER opportunity drawing  conforms to all applicable federal, state and local laws; the Contest is void where prohibited or restricted by law;

In the event the winner is found to be ineligible by virtue of any of the guidelines, a second drawing will be conducted (all entry tickets will be held for a period of 120 days) in the presence of the STOP CANCER Board of Directors. A member of TMS will be invited to attend and a new winner will be drawn in the same manner as the initial drawing.

The prize vehicle shall only be delivered in the continental United States. If the winner lives within a reasonable distance of TMS’s Torrance, California headquarters’ offices, the winner shall execute the necessary paperwork and take delivery of the prize vehicle at TMS’s principal place of business in Torrance, California. Otherwise, TMS shall use reasonable efforts to have the prize vehicle delivered to the authorized Lexus dealership closest to the winner’s primary residence in the continental United State;

TMS shall not be responsible for delays in delivery of the prize vehicle, and delivery is subject to availability. TMS, however, shall use all reasonable efforts, subject to availability, to deliver the prize vehicle within one hundred and eighty (180) days after receipt of the aforementioned items/information. The winner shall bear all risk of loss or damage to the prize vehicle after it has been delivered to the specified delivery site. The winner must personally retrieve the prize vehicle within 14 days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative winner shall be selected and the original winner’s rights to the prize vehicle shall be automatically forfeited); and

Acceptance of a prize constitutes permission for STOP CANCER and TMS and/or designees to use the winner’s name, address, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensation or notice to, or further consent of, the winner to the extent permitted by law.
